Terms & Conditions

Your Booking

  • All sessions are private and arranged exclusively for you/your party.

  • All participants must be over the age of 18.

  • Payment must be made before your booking is confirmed. Payment is made via invoice. Payment cannot be made by cash or cheque.

  • Hrossey Wanderer is not responsible for paying any fees which your bank may charge you when paying for your booking.

  • Once payment has been confirmed, you will receive your booking confirmation with detailed meeting time and place information, a kit list and suggestions for anything else you may wish to bring.

  • Being on foot in remote and/or rugged country is potentially hazardous, and participants must accept a certain element of risk. In the interest of safety, you must agree to abide by the instructions of your guide .

  • You must accept that any activity you participate in during your session is entirely at your own risk. Hrossey Wanderer does not accept any liability for any personal injury or loss of life sustained during your session.

  • You must ensure that you bring appropriate equipment and clothing along for your session. At a minimum, you will need a waterproof jacket, waterproof trousers and walking boots. Anything else required will be advised at the time of booking. If your clothing/equipment is deemed to be inadequate or unsafe, Hrossey Wanderer reserves the right to cancel your session without a refund.

  • Hrossey Wanderer reserves the right to amend/adapt a pre-planned route or itinerary in the light of prevailing weather or other safety reasons.

  • It is the responsibility of all participants to inform Hrossey Wanderer of any medical history or allergies that might affect their ability to take part in your session. This information is treated in strict confidence but may need to be disclosed to medical professionals in the event of an emergency. For further details, please see the Health & Fitness section of these Terms & Conditions.

  • Unfortunately, dogs are not permitted on any session unless they are assistance dogs.

Cancellation by the Client

All cancellations must be in writing (sent by email) and acknowledged by Hrossey Wanderer.

If you do have to cancel your booking, please let Hrossey Wanderer know in writing as soon as possible. If I am able to secure another booking for the same day, a full refund will be given. Otherwise, the following charges will apply:

  1. 50% refund if notified more than 3 days in advance of the booking.

  2. No refund if notified less than 3 days in advance of the booking.

Any refunds due will be made within 14 working days of Hrossey Wanderer acknowledging the cancellation.

All refunds will be in pounds sterling and any fluctuation in exchange rates cannot be my responsibility.

Cancellation by Hrossey Wanderer

Whilst every attempt is made to ensure your session runs as planned, Hrossey Wanderer reserves the right to cancel any course due to:

  • Circumstances outside its control, including, but not limited to, war, civil unrest, strikes, accident, incapacitating illness, fire, flood, travel disruption.

  • Dangerous and / or unsuitable conditions for the session being present or forecast.

If your session is cancelled by Hrossey Wanderer, you will be offered a choice of:

  1. An alternative time/date.

  2. A full refund.

Hrossey Wanderer shall not be liable for any consequential loss or damage arising from the cancellation, interruption, delay or alteration of or to any walk.

Any refunds due will be made within 14 working days of Hrossey Wanderer acknowledging the cancellation.

All refunds will be in pounds sterling and any fluctuation in exchange rates cannot be my responsibility.

Force Majeure

Hrossey Wanderer will be under no obligation or liability for any cancellation, interruption, delay or alteration of or to any session caused by act or threat of war (whether declared or not), riots, civil strife, terrorist activity, industrial disputes, discharge dispersal release or escape of pollutants, natural and nuclear disasters, fire, sickness, bad weather, technical or transportation problems, closure of stations, ports and airports, cancellation or changes of schedules by railways, ferry companies, air or bus lines or any other circumstances beyond our control amounting to force majeure and/or Act of God.

Group Bookings

If a client wishes to make a group booking a main contact must be provided when making the initial booking enquiry. Hrossey Wanderer will only deal with the main contact in relation to the booking, including any changes or cancellation. The main contact will be responsible for the payment of all deposits and course fees and it will be assumed by Hrossey Wanderer that the main contact has authority to act on behalf of all group members. Each group member must complete and submit a participation form to Hrossey Wanderer.

Participation Statement

All participants must sign the below acknowledgement of risk form and disclaimer before their session can commence.

Participants acknowledge that Hrossey Wanderer reserves the right to amend/adapt a pre-planned route or itinerary in the light of prevailing weather or other safety reasons.

Hrossey Wanderer reserves the right to terminate part or all of a session or to exclude a client from all or part of a course if a client’s actions present a danger to themselves and / or others or is detrimental to others enjoyment of the session. If Hrossey Wanderer exercises its right to terminate all or part of a session then no refund of session fees will occur.

Participants who do not obey the safety guidance or instructions of your guide and / or undertakes independent activities during a course will be deemed to have removed themselves from the session and will not be covered by any duty of care or the professional insurance of Hrossey Wanderer. No refund of session fees will occur.”

Health and Fitness

Hrossey Wanderer must be made fully aware of any medical problem, condition, disability, injuries or medication of a client before booking. If any medical issues change, arise or are suffered, between booking and the commencement of the session, Hrossey Wanderer must be notified immediately.

Hrossey Wanderer reserves the right to refuse or cancel a booking on medical grounds, if it is considered to be detrimental to the safety and smooth running of the session. If cancelled, the cancellation charges set out in these Terms and Conditions (Cancellation by the Client) will apply.

Clients should familiarise themselves with the different levels of exertion likely to be needed for their booking and ensure it is suitable for their level of health and fitness. If there is any doubt as to the level of fitness required for a particular course or activity, please contact Hrossey Wanderer before booking. Clients should arrive for their session suitably fit and prepared for the activities.

Equipment

The client is responsible at all times for their personal property and equipment and for ensuring it is suitable and safe for use during their session. Hrossey Wanderer will not be responsible for any loss or damage to a client’s personal property or equipment used on a course.

If Hrossey Wanderer issues a client with property or equipment for use on a course, the client will at all times be responsible for its safekeeping and proper use. Hrossey Wanderer reserves the right to charge for any property and / or equipment lost, damaged or misused by a client during a session.

Transport

Transport is not included in the course fee. It is the client’s responsibility to get to the starting location/venue at the time specified. It may be necessary for a client to utilise their own transport during a booking: if they do, Hrossey Wanderer accepts no responsibility for any loss or damage arising directly or indirectly from that use.

Insurance

Hrossey Wanderer shall not be liable for any consequential loss or damage arising from the cancellation, interruption, delay or alteration of or to any booking. For all sessions, clients are advised to take out travel and/or personal insurance that covers them for the course activities they will be undertaking. These insurance policies will usually include cover for cancellation, curtailment, loss or damage to personal property and equipment, personal accident and personal liability. It is the client’s responsibility to ensure they are adequately insured.

Photographs

Photographs and video footage taken on a course may be used by Hrossey Wanderer for publicity purposes on its website and in promotional material (including on social media). If a client does not consent to this they must inform Hrossey Wanderer at the time of booking or the tour guide immediately prior to the start of the session.

Data Protection

Hrossey Wanderer is registered with the Information Commissioner for data protection purposes and has appropriate procedures and security measures in place to protect client’s personal information.

When a client makes a booking, they are deemed to consent to their personal information (including medical information) being held by the guide for the purpose of providing the session. It may also be passed to medical personnel if required.

Complaints

In the unlikely event that you have any reason to complain or experience any problems with your session, you should contact Hrossey Wanderer immediately and I will do my best to resolve the problem as soon as possible. Should it not be possible to contact me immediately, you should write to me, giving full details, within 14 days of the session date.

Copyright Statement

The contents of Hrossey Wanderer publications, including including it’s website, are protected by copyright and may not be copied, stored or transmitted, in any part, without prior written consent of Hrossey Wanderer.

General

If any of these Terms and Conditions is found to be unlawful, invalid or unenforceable, it shall be deemed modified to the extent necessary to make it valid, legal or enforceable. If such modification is not possible, the relevant provision or part of it will be treated as severed from the remainder of these Terms and Conditions which will remain legal, valid and enforceable.

No third party rights are granted.

Hrossey Wanderer reserves the right to amend these terms and conditions at any time.
